Michael Jordan Tells Court He Felt No Fear of the Racing Body in Legal Battle

Michael Jeffrey Jordan, as he cordially introduced himself in a Charlotte court on Friday, admitted that his competitive side and status as a newcomer emboldened his effort with 23XI Racing to confront Nascar over alleged violations of competition laws.

Team Investment and a Competitive Drive

The owner disclosed financial and corporate details of his racing venture, revealing he invested $40m of his personal wealth into the Nascar Cup series team launched with business partner Curtis Polk and driver Hamlin.

“Someone had to step forward,” Jordan said in the Charlotte courtroom. “I was a new person, I had no fear. I believed I could take on Nascar in its entirety. I felt as far as the sport it needed to be looked at through a new lens.”

The Core Dispute: Charter Agreements and Contract Pressure

The heart of the case involves the expiration of a 2016 deal where Nascar provided each team a “charter”. This system mirrors other professional sports with independent franchises, such as the NBA’s Hornets or the NFL’s Panthers. This deal was set to expire in 2024 when Nascar insisted on charter membership renewals.

Jordan testified for about sixty minutes and exited the courthouse to pandemonium, with fans and media clamoring for a glimpse or a picture of the sports legend.

Spearheading the Fight

Jordan’s 23XI is leading the full-court press along with Front Row Motorsports for Nascar to change a business model Jordan said is breaking the law to maintain excessive control.

For Jordan and and Heather Gibbs, who preceded Jordan, are details from last September. She recounted a hectic and tense period where the racing circuit informed teams they had to sign a charter agreement extension. This agreement spanned over a hundred pages detailing pay for chartered teams and a guaranteed entry in Nascar-sponsored races.

Choosing Litigation

Jordan said that 23XI and Front Row Motorsports concluded their sole viable path was to decline to sign that 112-page package and litigate the matter. The other 13 organizations signed the agreement.

Jordan and co-owner Denny Hamlin approached Nascar about possible changes or extension options. Nascar wasn’t talking, Jordan said.

The Ultimate Motivation: Victory

But in the end, the resistance against what he saw as a financially unsustainable model was driven by the usual bottom line for Jordan: Winning.

“Denny convinced me adding a third car improved our chances to win,” he said, noting that he bought a third charter last year for $28m despite the uncertainty. “So I took the plunge.”

Heather Gibbs’ Testimony

Gibbs described her push for indefinite franchises, which she said a written letter to Nascar. She testified the timing of the contract signing demand was problematic.

She said, the team founder first tried to call and persuade Nascar against demanding signatures, but Nascar’s leader declined the request.

“Please don’t force this on us,” Gibbs recounted was the message to Nascar’s leadership. The response was, “If I wake up and I have 20 charters, I have 20. If I have 30, I have 30.”
