Federal Judge Orders Release of Kilmar Abrego Garcia from Immigration Custody

A court has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment lacks lawful basis.

"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her order.

The case stems from a erroneous removal to El Salvador in March, which the government later acknowledged was an mistake. After his return to the United States to answer alien smuggling allegations, he was held in federal detention.

In her decision, the judge pointed out that the government does not have a current removal order, which prevents them from deporting Mr. Abrego Garcia "for now."

The legal challenge involve conflicting claims. While the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically denies this claim.

He has also entered a not guilty plea to the conspiracy counts, which are part of a separate criminal case in the state of Tennessee.
